CONKER BIKES LTD. TERMS AND CONDITIONS OF USE, TERMS OF SALE, AND PRIVACY POLICY

This document sets out the terms on which you may use our websites, purchase products from us, and how we handle your personal data. It should be read carefully before using our services.

Conker Bikes Ltd is an independent legal entity. References on our websites to being “from the team behind Sinclair Innovation” describe design heritage and personnel background only and do not indicate group ownership, control, or agency. 

 

2. SCOPE OF THESE TERMS 

These terms apply to: 

  • Use of our websites, including conkerofcambridge.com and cocoonbike.com 

  • Sales of physical products including the Conker Safety Trailer and Cocoon child bike seat 

  • Digital products such as manuals and documentation 

  • Pre-orders and campaign-based sales, including via crowdfunding platforms 

Separate terms may apply to sales made through third-party platforms such as Amazon or Kickstarter. Where that is the case, the relevant platform’s terms apply in addition to, and in some cases in place of, these terms. 

 

3. WEBSITE USE 

You may use our websites for lawful purposes only. You must not: 

  • Misuse the websites by introducing malware or attempting unauthorised access 

  • Infringe our intellectual property rights 

  • Use our content for commercial purposes without permission 

We may suspend or withdraw access to our websites at any time without notice. 

 

4. INTELLECTUAL PROPERTY 

All content on our websites and all products, including designs, text, images, manuals, trademarks, registered designs and patents, are owned by or licensed to Conker Bikes Ltd. 

You must not copy, modify, reverse engineer, manufacture accessories for, or create derivative works based on our products without our prior written consent. Unauthorised accessories or modifications may infringe our intellectual property rights and invalidate warranties. 

 

5. PRODUCTS AND DESCRIPTIONS 

We aim to ensure product descriptions are accurate. However, minor variations may occur. Images are illustrative only. 

The Conker Safety Trailer is designed and tested to meet EN 15918 standards. Use of the trailer must be in strict accordance with the official Conker Safety Trailer Owner’s Manual supplied with the product. 

 

6. ORDERS AND CONTRACT FORMATION 

A contract is formed when we confirm dispatch of your order. 

We reserve the right to refuse or to cancel orders, including where products are unavailable, pricing errors occur, or we reasonably suspect misuse or fraud. 

 

7. PRICING AND PAYMENT 

Prices are shown exclusive of delivery costs unless stated otherwise. Delivery charges are calculated and shown at checkout or agreed separately. 

We accept payment via third-party payment processors. We do not store full payment card details. 

 

8. DELIVERY 

Delivery times are estimates only. 

During product launch phases or pre-order campaigns, delivery may take longer and may extend up to three months from order confirmation. 

Risk of loss or damage passes to the carrier upon dispatch. Standard carrier insurance applies. Title to goods passes to you once payment has been received in full. 

For international orders, delivery costs, customs duties, taxes, and import charges are your responsibility unless otherwise stated. 

 

9. CANCELLATIONS AND RETURNS 

Consumer cancellation rights 

If you are a consumer in the UK or EU, you have the right to cancel your order within 14 days of receiving the goods, except where exclusions apply. 

To cancel, you must notify us by email. You must return the goods without undue delay and at your own cost. 

Returned goods must be unused, complete, and in resaleable condition. 

Refunds 

Refunds will be made to the original payment method within 14 days of receiving and inspecting the returned goods. 

Faulty goods 

Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015. 

 

10. MADE-TO-ORDER AND CUSTOM PRODUCTS 

Where products are made to order or customised at your request, cancellation rights may not apply once manufacture has begun. This does not affect your statutory rights for faulty goods. 

 

11. WARRANTY AND PRODUCT-SPECIFIC TERMS 

Conker Safety Trailer 

Warranty terms for the Conker Safety Trailer are set out in the official Conker Safety Trailer Owner’s Manual supplied with the product and incorporated into these terms by reference. The manual includes detailed safety warnings, usage requirements, exclusions, and warranty periods. 

Use of non-Conker Bikes approved accessories or modifications will invalidate the warranty. 

Cocoon child bike seat 

The Cocoon child bike seat is supplied with the full protection of your statutory consumer rights under UK law. These rights apply automatically and independently of any manufacturer guarantee. In addition, the Cocoon has been designed, engineered and manufactured with a strong emphasis on safety, durability and regulatory compliance, and is intended to meet or exceed all applicable UK and EU product safety requirements at the time of supply.  

 

12. SAFETY AND LIMITATION OF LIABILITY 

Our products are safety-critical. You must read and follow all instructions and warnings supplied with them. 

To the maximum extent permitted by law, we are not liable for: 

  • Injury or damage caused by misuse, modification, incorrect assembly, or failure to follow instructions 

  • Normal wear and tear 

  • Use with incompatible bicycles or vehicles 

Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law. 

 

13. TRADE CUSTOMERS 

Trade sales are available by prior arrangement only and are subject to separate contractual terms. Consumer protection legislation does not apply to trade customers except where required by law. 

 

14. CROWDFUNDING CAMPAIGNS 

Where products are sold via crowdfunding platforms such as Kickstarter, pledges are governed by the platform’s terms and conditions. Delivery timelines are estimates and may change. Statutory rights apply where applicable. 

 

15. PRIVACY POLICY 

Personal data we collect 

We may collect personal data including names, contact details, delivery addresses, payment information, website usage data, and marketing preferences. 

How we use your data 

We use personal data to: 

  • Process orders and provide products 

  • Communicate with customers 

  • Comply with legal obligations 

  • Improve our websites and services 

Legal basis 

Processing is carried out on the basis of contract, legal obligation, legitimate interests, or consent, as appropriate. 

Marketing 

We send marketing communications only where you have opted in. You may withdraw consent at any time. 

Data sharing 

We share data with trusted service providers including payment processors, hosting providers, analytics services, and logistics partners, only as necessary to operate our business. 

Data retention 

We retain personal data only for as long as necessary for the purposes for which it was collected. 

Your rights

We use cookies to operate our websites and to analyse usage. Non-essential cookies are used only with your consent. You can manage cookie preferences through our cookie banner and browser settings. 

 

17. ALTERNATIVE DISPUTE RESOLUTION 

If you are a consumer and are unhappy with how we have handled a complaint, you may be entitled to use an Alternative Dispute Resolution provider approved under UK law. Use of ADR is voluntary and does not affect your right to bring proceedings in court. 

 

18. GOVERNING LAW AND JURISDICTION 

These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction. 

 

19. CHANGES TO THESE TERMS 

We may update these terms from time to time. The version in force at the time of your order will apply.
